1. Ownership Notice

All content published on this website (avazando.com), including but not limited to product photography, product videos, video advertisements, graphics, illustrations, written copy, page layouts, and brand assets (collectively, "Content"), is the exclusive property of CTF Fortis ("Owner"), unless otherwise stated. This Content is protected under U.S. and international copyright law.

Ownership of this Content is not transferred, licensed, or waived by its public availability on this website or on any social media channel where it may be distributed (including but not limited to Facebook, Instagram, TikTok, YouTube, and Pinterest).

2. Prohibited Use

No part of the Content — including any image, photograph, video, or video advertisement — may be copied, reproduced, downloaded, republished, redistributed, modified, or used in any form, on any platform (including competitor websites, e-commerce stores, and social media advertising channels), without the prior express written permission of CTF Fortis.

This prohibition applies regardless of where the Content is found or redistributed from, including copies taken from this website directly or from any social media channel on which CTF Fortis or Avazando has published the Content.

3. Filing a DMCA Takedown Notice

If you are a copyright owner, or authorized to act on behalf of one, and you believe your copyrighted work has been infringed on this website, please submit a written notice to our Designated Copyright Agent below, including:

  • A physical or electronic signature of the copyright owner or authorized representative.
  • Identification of the copyrighted work claimed to be infringed.
  • Identification of the allegedly infringing material and its location (specific URL).
  • Your contact information (address, phone number, email).
  • A statement of good faith belief that the use is not authorized.
  • A statement, under penalty of perjury, that the information is accurate and that you are authorized to act on behalf of the copyright owner.

4. Counter-Notification

If you believe material was removed or disabled by mistake or misidentification, you may submit a counter-notification containing:

  • Your physical or electronic signature.
  • Identification of the removed material and its prior location.
  • A statement under penalty of perjury that you have a good faith belief the removal was a mistake or misidentification.
  • Your name, address, phone number, and a statement consenting to the jurisdiction of the Federal District Court for your address, and that you will accept service of process from the original complainant.

Send counter-notifications to the same Designated Copyright Agent above. Upon a valid counter-notification, the material may be reinstated within 10–14 business days unless the original complainant files a court action.

5. Enforcement and Damages

CTF Fortis and Avazando actively monitor the internet, including competitor stores, advertising platforms, and social media channels, for unauthorized use of the Content described in Section 1.

Any party found to have copied, reproduced, or substantially replicated the Content without prior written authorization will be deemed in violation of this policy. In addition to any remedy available under the DMCA and applicable copyright law — including statutory damages of up to $150,000 per work for willful infringement under 17 U.S.C. § 504(c)(2) — CTF Fotis will seek liquidated damages of no less than $5,000 USD per infringing item (per image, per video, or per page/listing found to contain unauthorized Content), as a minimum measure of harm suffered, without prejudice to seeking additional actual damages, lost profits, or attorneys' fees where applicable.

This provision serves as formal notice of our enforcement position and does not limit any other legal remedy available to CTF Fortis or Avazando.

6. Repeat Infringement

Any party found to have infringed the Content on more than one occasion will be treated as a repeat infringer. In such cases, CTF Fortis reserves the right to:

  • Pursue the full damages described in Section 5 for each individual instance of infringement, cumulatively.
  • Escalate enforcement directly through legal counsel without further prior notice. 
  • Report the infringing party's account, store, or advertising account to the relevant platform (Shopify, Meta, TikTok, etc.) for suspension or termination, in addition to any DMCA or IP infringement claim already filed.
  • Pursue injunctive relief to prevent further use of the Content.

A repeat infringer is any party against whom a valid, unretracted copyright claim has previously been submitted or upheld by a platform, and who is subsequently found to infringe again.

7. False Claims

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be liable for damages, including costs and attorneys' fees. Please only submit notices in good faith.
